    TOPIC OF DISCUSSION
TO LITIGATE OR ARBITRATE, THAT IS THE QUESTION: WHEN IN DOUBT, MEDIATE!
The construction industry is contentious! So, what is the best way to resolve disputes?
There are various factors to consider before agreeing to one particular procedure:

    • Cost:  Don’t believe that arbitration is always cheaper!
    • Time:  Litigation will take longer, especially when the courts are backlogged.
    • Finality:  No right to appeal in arbitration.  That’s good or bad depending on your outcome.
    • Settlement:  Mediation is the fastest and cheapest way to the finish line.

Thank you to the AGC for sharing this important information with our members!
